Understanding Your Special Enrollment Rights Under a Group Health Plan

If you are eligible for a group health insurance plan, it is important to know your rights when it comes to enrolling outside of the typical open enrollment period. Life can bring unexpected changes, and certain events may qualify you for what is known as a Special Enrollment Period. This gives you another opportunity to sign up for coverage when specific conditions apply.

Here’s a clear breakdown of when you might qualify and what you need to do to secure coverage for yourself or your dependents.

Losing Other Health Coverage

If you previously declined enrollment in your group health plan because you had other coverage, such as through a spouse’s plan or individual insurance, you may be able to enroll later if that coverage ends. This also applies if your employer or your spouse’s employer stops contributing to your or your dependents’ health coverage.

You must request enrollment within 30 days of the date the other coverage ends or the date the employer stops contributing toward that coverage.

Adding a New Dependent

Certain family changes can also qualify you for special enrollment. These include:

  • Marriage
  • Birth of a child
  • Adoption of a child
  • Placement of a child for adoption

You must request enrollment within 30 days of the event, such as the date of marriage or the day your new child joins your family.

Changes in Medicaid or CHIP Coverage

If you or your dependents are covered by Medicaid or a state Children’s Health Insurance Program (CHIP), losing that coverage may make you eligible for special enrollment in your group health plan. You must request enrollment within 60 days of losing Medicaid or CHIP coverage.

Additionally, if you or your dependents become eligible for financial assistance through a state Medicaid or CHIP program to help pay for your group health coverage, you can enroll in your plan at that time. If this situation applies to you, you must request enrollment within 60 days of becoming eligible for the premium assistance subsidy.

Take Action Quickly

Missing the window to request enrollment can delay access to benefits, leaving you and your loved ones without important coverage. If you experience any of the events listed above, notify your benefits administrator right away and complete any required paperwork within the timeframe provided.
